Agreement to Contribute to Katiqsugat: Inuit Early Learning Resources

Thank you for your interest in contributing an item to Katiqsugat: Inuit Early Learning Resources (“Katiqsugat”), a digital collection maintained by Inuit Tapiriit Kanatami (ITK), the national Inuit organization in Canada.
The following sections contain important information about your rights and responsibilities relating to the contribution of materials to Katiqsugat. These terms were developed to ensure an appropriate balance between your rights as a contributor to Katiqsugat and access to Katiqsugat for educational purposes. By submitting material to Katiqsugat, you agree to the terms set out below. Please read this Agreement carefully and contact us with any questions you may have.
1. YOUR RIGHTS
Ownership: You retain copyright in material you have created or authored, which you submit to Katiqsugat. You maintain the right to publish the material elsewhere.
Control: You may request the removal of your item from Katiqsugat, at any time. You may also change the conditions under which your item can be accessed and used by others. It should be noted, however, that removal of material from Katiqsugat will not limit the ability of users who have already accessed the material to use or re-use that material lawfully. Attribution: ITK will acknowledge your contributions to Katiqsugat unless you request to remain anonymous when you submit your material or when you give notice that you would like to remain anonymous at a later time. For any item you contribute, you will be acknowledged as the author, the copyright holder, or both (as applies).
2. SUBMISSION OF MATERIAL
Minimum age requirement
Individuals must be 18 years of age or older to submit material to Katiqsugat.
Confirming your right to submit
By submitting material to Katiqsugat you warrant that you hold copyright in the material or otherwise have the legal right to submit material to Katiqsugat and grant license to ITK to use the material as outlined in the sections below in a way that would not constitute an infringement of the Canada Copyright Act. If the material has more than one author, the individual submitting the material warrants that he or she has the consent of each author to include the material in Katiqsugat.
Intellectual property rights and Traditional Knowledge
For items containing representations of traditional knowledge or other culturally sensitive material, and when the author or authors are not considered the rightful custodians or knowledge keepers, they must either identify the custodian(s) and/or provide evidence at time of submission that they have received approval to submit the material to Katiqsugat. When the custody or ownership of traditional and community knowledge is unknown, authors should consult with a cultural resource centre, heritage centre, archive, or other community organization to determine the most appropriate process for obtaining consent to submit the material to Katiqsugat.
ITK does not endorse authors who have received approval to use representations of traditional knowledge as the copyright holder. Intellectual property rights to representations of traditional knowledge continue to reside with the community or communities despite inclusion in Katiqsugat.
We welcome other suggestions and ways we can protect community knowledge and support community contributions to Katiqsugat.
3. ACCESS TO SUBMITTED ITEM
License to ITK
By submitting material to Katiqsugat you grant ITK a royalty-free, worldwide, non-exclusive licence (but not the obligation) to reproduce, store, use, and display to the public the material, in any digital form, in whole or in part, and in syndication (for example, on social media feeds) in connection with the promotion of Katiqsugat subject to the Permissions for and Restrictions on Access and Use stipulated by you upon submission. Please see the Access and Use sections below for an explanation of the kinds of Permissions for and Restrictions on Access that a contributor may apply to their material.
General Access
All items in Katiqsugat are openly accessible unless the contributor otherwise requests. This means that items can be searched, viewed and downloaded in their entirety with no cost to the individual user or password login required.
Permissions for and Restrictions on Access
ITK recognizes, however, that contributors may want to require that members of the public seek permission before they can access their items. Authors may also want to restrict access to their item to certain situations. Under these and similar circumstances, ITK will accept submissions of items that are not intended to be accessed by the general public and will not be included as an openly accessible item in Katiqsugat.
Different ways that ITK can require permissions to or apply restrictions on access to the item include the following:
- Providing only a description of the item in Katiqsugat but not a copy of the item;
- Displaying your contact information and specific instructions for other users to request access to the item on a case-by-case basis;
- Listing you and/or your affiliation as a unique entity within Katiqsugat, for example, a resource centre, a community hub, a web portal, or a knowledge keeper/custodian.
If you want to apply permissions to or restrictions on access to the item you submit, you must specify these at time of submission using the item submission form. If no additional permissions or restrictions are stated at time of submission, your item, if accepted, will be made available openly accessible as outlined above.
We welcome other suggestions and ways we can support you contributions to Katiqsugat.
4. USES OF SUBMITTED ITEM
In addition to conditions regarding access to Katiqsugat items, there are conditions regarding the use of Katiqsugat items. Unless the copyright holder otherwise requests, the submitted item can be used in the following ways and for non-commercial purposes only and as long as appropriate attribution is made to the author of the item:
- The general public and individual users can download your item.
- The general public and individual users can make copies of your item. This includes copying the item in different formats, for example, printing off a physical copy.
- The general public and individual users can share copies of your item with others.
- The general public and individual users can adapt your item for another Inuit-specific, early learning context. This includes activities like making a video or audio version of a print resource or adapting a Nunavik-related resource for an urban Ottawa setting.
- The general public and individual users can translate your item into other languages.
Additionally, use of Katiqsugat items must always be in accordance with Katiqsugat's Terms of Use and Website Policies.
Permissions for and Restrictions on Use
ITK recognizes that some items may include sensitive material and/or their contributors may want to apply certain limitations and restrictions on their use. Under these and similar circumstances, ITK will accept submissions of items that are subject to more restrictive use permissions. Different ways that ITK can require permissions to or apply restrictions on use of the item include the following:
- Limiting particular uses to specific individuals, communities, and individuals;
- Displaying your contact information and specific instructions for other users to request permission first before using the item in a particular way;
- Requiring individuals who have adapted or translated your item to also submit their new version(s) to Katiqsugat;
- Requesting compensation for particular uses of the item.
If you want to apply permissions to or restrictions related to use of your item, you must specify these at time of submission using the item submission form. If no additional permissions or restrictions are stated at time of submission, your item may be used in the ways listed above.
We welcome other suggestions and ways we can support you contributions to Katiqsugat.
5.LIMITATION OF ITK’S LIABILITY
ITK is not liable for improper use of material in Katiqsugat by Katiqsugat users or third parties. ITK is not liable for inaccurate information contained in Katiqsugat. ITK is not responsible for lost profits, revenues, or data; financial losses or indirect, special, consequential, exemplary or punitive damages arising from submission to or use of Katiqsugat.
You and/or the author, copyright holder or business on behalf of which you contribute material or use Katiqsugat will hold harmless and indemnify ITK and its affiliates, officers, agents and employees from any claim, suit or action arising from or related to the contribution to Katiqsugat or to the use of Katiqsugat or violation of these terms by you and/or another user or contributor.
6. AMENDMENTS
ITK may, from time to time, amend this Agreement, for example, to reflect changes to the laws of the province of Ontario and the country of Canada. ITK will amend the Agreement by posting amendments and updating the date of last revision of the Agreement. Upon posting amendments, the updated Agreement, is immediately effective. Submission of material for consideration in Katiqsugat constitutes acceptance of the amendments and the entire Agreement.
7. APPLICABLE LAW
This Agreement is governed by the laws of the province of Ontario, and where relevant, the laws of the country of Canada.
